Our Privacy Policy
This Privacy Policy discloses the privacy practices for the www.planyear.com website and related services (together referred to as the “Site”). PlanYear, Inc., the owner and operator of the Site (referred to as “PlanYear,” “us,” or “we”), is committed to protecting your privacy online.
You acknowledge that this Privacy Policy is part of our Site Terms and Conditions of Use, and by accessing or using our Site, you agree to be bound by all of its terms and conditions. If you do not agree to these terms, please do not access or use this Site.
We reserve the right to change this Privacy Policy at any time. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to posting the revised Policy on the Site. You acknowledge and agree that it is your responsibility to review this Policy periodically and to be aware of any modifications. Your continued use of the Site after such modifications will constitute your: (a) acknowledgment of the modified Policy; and (b) agreement to abide and be bound by the modified Policy.
1. What information do we collect from you?
In order to better provide you with our numerous services, we collect two types of information about our users: Personally Identifiable Information and Non-Personally Identifiable Information. Our primary goal in collecting information from you is to provide you with a smooth, efficient and customized experience while using the Site.
Personally Identifiable Information: This refers to information that lets us know the specifics of who you are. When you engage in certain activities on the Site, such as registering for our service, submitting and/or posting content, requesting a demonstration of our service, filling out a survey, or sending us feedback, we may ask you to provide certain information about yourself by filling out and submitting an online form. Depending on the service or product you are interested in, we may ask that you provide us with personal information, such as your first and last name, work title, company name, telephone numbers, email address, date of birth, details of family members, financial information, and details about your medical conditions, prescribed medications, and other health and wellness-related information. Depending upon the activity, some of the information we ask you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity.
Non-Personally Identifiable Information: This refers to information that does not by itself identify a specific individual. We gather certain information about you based upon where you visit on the Site in several ways. This information is compiled and analyzed on both a personal and an aggregated basis. This information may include the Uniform Resource Locator (“URL”) of the website from which you just visited before coming to the Site, the URL which you go to next, the type of browser you are using, and your Internet Protocol (“IP”) address.
2. How do we collect information from you and how do we use it?
We collect Personally Identifiable Information about you when you voluntarily provide it to us. For example, you provide certain Personally Identifiable Information to us when you: (a) register for our services or register your e-mail address with us; (b) request a demonstration of our service; (c) sign up for special offers; (d) send e-mail messages, submit forms or transmit other information to us by telephone or letter; or (e) submit your credit card or other payment information if we make such payment functionality available on the Site and you use it to order and purchase products or services. We may also receive Personally Identifiable Information from your employer as we set up your account, and may receive Personally Identifiable Information from your insurance provider or other third parties that are requested or authorized by you.
We also collect certain Non-Personally Identifiable Information. For example, we may automatically collect some information when you visit the Site, such as your computer’s IP address, operating system, and the time and date of your visit.
We use your Personally Identifiable Information to provide our services to you, and for the specific purpose for which it was volunteered. We will also use Personally Identifiable Information to enhance the operation of the Site, fill orders, improve our marketing and promotional efforts, statistically analyze and improve our product and service offerings, customize the Site’s content, layout, and services, and create and publish reports that are aggregated (but which do not identify individual persons). We may use Personally Identifiable Information to deliver information to you and to contact you regarding administrative notices and to notify you about changes to the Site or our services. We may also use Personally Identifiable Information to resolve disputes, troubleshoot problems, to enforce our agreements with you, including our Site Terms and Conditions of Use, Consent and Authorization Form and this Privacy Policy, and as permitted by, and to comply with, any legal or regulatory requirements, process or provisions.
We may also process Personally Identifiable Information to provide our products and services – such as audit, research and analyze data to maintain, protect and improve our services; ensure the technical functioning of our network; and developing new services.
We will not collect or use Personally Identifiable Information for purposes other than those described in this Policy and/or in the specific service notices, unless we have obtained your prior consent.
3. With whom do we share your information?
We do not sell, trade, or rent your Personally Identifiable Information to others without your consent. We do provide some of our services through contractual arrangements with affiliates, services providers, business partners and other third parties. We will collectively use your Personally Identifiable Information to operate our Site and to deliver our products and services. For example, we will use your social security number to look up and analyze your prescription data, as well as pull and analyze your claims information in order to find the optimal health plan and savings for you. We will provide your Personally Identifiable Information to our service partners for the limited purposes outlined in this Privacy Policy.
We may also access and disclose your personal information in the event that we were to sell or buy any business or assets, in which case we may disclose your Personally Identifiable Information to the prospective seller or buyer of such business or assets, and if PlanYear or substantially all of its assets were to be acquired by a third party, information about our subscribers would likely be one of the transferred assets. Additionally, we may disclose Personally Identifiable Information as may be permitted or required by law, regulation, rule or court order; pursuant to requests from governmental, regulatory or administrative agencies or law enforcement authorities; or to prevent, investigate, identify persons or organizations potentially involved in, or take any action regarding suspected fraud, violations of our Terms and Conditions of Use, or activity that appears to us to be illegal or may expose us to legal liability; in situations that we believe to be emergencies involving potential threats to our physical safety or to protect the rights, property, or safety of PlanYear, our subscribers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.
4. How can you update, correct, or request the removal of your Personally Identifiable Information?

6. What are your choices regarding collection, use, and distribution of your information?

7. What security precautions are in place to protect against the loss, misuse, or alteration of your information?
In addition, access by you to your Personally Identifiable Information is available through a password and unique customer ID selected by you. This password is encrypted. We recommend that you do not divulge your password to anyone. In addition, your Personally Identifiable Information resides on a secure server that only selected company personnel have access to via password. We encrypt your Personally Identifiable Information when it is transmitted between You and us to prevent unauthorized parties from viewing such information during transmission.
Information that you provide that is not Personally Identifiable Information also resides on a secure server and is only accessible via password. Since this information is not accessible from outside the company you will not be asked to select a password in order to view or modify such information.

8. Do we use “cookies”?
When you use the Site, we store cookies on your computer to facilitate and customize your use of the Site (e.g. we use cookies to store encrypted session information and maintain secure access to our site). Many of our advanced features, including certain services and products will not work if cookies are disabled.
A cookie is a small data text file, which a Web site stores on your computer’s hard drive (if your Web browser permits) that can later be retrieved to identify you to us. We use cookies to improve the quality of our products and services by storing user preferences and tracking user trends, such as how people search and navigate the Site. The cookies make your use of the Site easier, make the site run more smoothly and help us to maintain a secure Site. You are always free to decline our cookies if your browser permits, but some parts of the Site may not work properly in that case.
Some of the cookies we use may be operated by third parties, such as Google Analytics or ActOn. Google Analytics/ActOn enables website operators like us and our third-party vendors, including Google, to match the interests of the Site’s visitors with appropriate ads after they leave our website through remarketing strategies. As a result, a visitor to the Site may see a customized advertisement on a Google search results page, or other webpage, after leaving the Site. Data collected through the use of “DoubleClick cookies” will only be used in accordance with this privacy statement and Google’s privacy policy. No personal health information will be available under such cookies. You can set preferences for how Google advertises to you by visiting Google’s Ads Settings page here. You can also permanently opt-out of the Google Analytics Advertising Features by visiting this page. Additional information about how Google Analytics collects and processes data is available here.
Because technology is constantly changing, however, we may change the types of cookies that are used with the Site from time to time. We will update this Privacy Policy in accordance with applicable law if we materially change the manner in which we collect information.
